At today’s seventh meeting, the Council of the Agency for Prevention of Corruption, deciding upon requests for free access to information, has taken a position, by consensus, that submitters of the requests as well as any other interested legal and physical entity will be provided - on an equal base and under the same conditions - with access to the requested information - minutes from the fifth meeting of the Council of the Agency, whose integral part is the audio recording of the meeting.
Upon the request by Mr Željko Tomović, candidate in the process of election of Director of the Agency for Prevention of Corruption, the Council of the Agency unanimously permitted the named the insight into files and photo-copying of case files related to Mr Sreten Radonjić, candidate in the process of election of Director of the Agency for Prevention of Corruption, in line with the Personal Data Protection Law and
Law on Data Confidentiality, within five days from the day of delivery of the decision.
The Council of the Agency limited, by a majority of votes (total of five members of the Committee voted, four for - Ms Goranka Vučinić, President of the Council of the Agency, Mr Ristan Stijepović, Mr Radule Žurić and Mr Bojan Obrenović, members of the Council, and one against - Vanja Ćalović, member of the Council), access to Mr Željko Tomović to the requested information - “delivery of audio-visual or only audio recording and minutes from the fifth meeting of the Council of the Agency for Prevention of Corruption” until verification of the minutes from the fifth meeting of the Council, for exercising official duties, in line with Article 14, paragraph 1, item 4, indent 3 and with regard to Article 15 paragraph 4 of the Law on Free Access to Information. Members of the Committee decided that the minutes from the fifth meeting, whose integral part was the audio recording of the meeting, would be delivered to the named after its verification.
Upon the request by Mr Muhamed Gjokaj, President of the Council of the Agency for Personal Data Protection and Free Access to Information, the Council of the Agency for Prevention of Corruption, by a majority of votes (total of five members of the Committee voted, four for - Ms Goranka Vučinić, President of the Council of the Agency, Mr Ristan Stijepović, Mr Radule Žurić and Mr Bojan Obrenović, members of the Council, and one against - Vanja Ćalović, member of the Council), limited to the named access to the requested information - “copy of the minutes and audio recording from the meeting deciding on the election of president of the Agency for Prevention of Corruption”, until verification of the minutes from the fifth meeting of the Council, for exercising official duties, in line with Article 14, paragraph 1, item 4, indent 3 and with regard to Article 15 paragraph 4 of the Law on Free Access to Information. Members of the Committee decided that the minutes from the fifth meeting, whose integral part was the audio recording of the meeting, would be delivered to the named after its verification.
Upon the request by Ms Snežana Jonica, Member of the Parliament of Montenegro, members of the Council decided to deliver the answer to the named that the Council of the Agency for Prevention of Corruption did not address the Council of the Agency for Personal Data Protection “for the purpose of providing opinion whether interviewing of candidates for Director of the Agency for Prevention of Corruption at the meeting opened to the public was contrary to the Personal Data Protection Law”, and also that the minutes from the fifth meeting of the Council, which would include the interview with the candidates for the election of Director of the Agency for Prevention of Corruption, with authentic content of all questions posed by members of the Council and the responses by candidates, following verification by the Council of the Agency, be published on the website of the Parliament of Montenegro, in the section of the Council of the Agency for Prevention of Corruption, and recording of the meeting of the Council of the Agency represented the basis for drafting the minutes of authentic content. Members of the Committee decided that the minutes from the fifth meeting, whose integral part was the audio recording of the meeting, would be delivered to the named after its verification.
Upon the request of Ms Vanja Ćalović, member of the Council of the Agency, regarding the delivery of audio recordings from all meetings of the Council of the Agency, members of the Council, by a majority of votes (total of five members of the Committee voted, two for - Ms Goranka Vučinić, President of the Council of the Agency and Vanja Ćalović, member of the Council and and three against - Mr Ristan Stijepović, Mr Radule Žurić and Mr Bojan Obrenović, members of the Council), decided that recordings of the meetings would be delivered to the named after their verification.
The Council decided unanimously to address the Director of the Agency for Prevention of Corruption, so that the Council of the Agency be provided with professional help by employees of the former Directorate for Anti-Corruption Initiative, and also for the purpose of providing funds for the work of members of the Agency Council, as well as for delivering the expert opinion of the European Commission on bylaws of the Agency to the Council of the Agency, and review of implemented and planned visits and trainings for employees of the Agency.
