At the meeting, President Krivokapić reminded that on 16 July the Parliament of Montenegro adopted the Law on settling obligations towards the workers of Aluminium Plant who retired early due to bankruptcy of the company. This Law prescribes that workers of KAP, who had not been given adequate severance pay prior to retirement, shall be entitled to severance pay. Furthermore, it was prescribed that the amount of the severance pay would be defined in accordance with the current social programme made for workers of KAP. The funds for this purpose have been allocated in the 2016 Budget.
During the meeting it was estimated that the statement of Minister of Economy Mr Vladimir Kavarić - that the Government would not pay for severance pay to retired workers of KAP because “The Law is not applicable, as well as because there is unofficial information that the constitutional review of this law will be initiated” - was very alarming, because it implied that the Government of Montenegro would not observe the Law, i.e. that it would not carry out its legal obligations. As it was estimated, such intention and conduct are the most direct action contrary to the Constitution and the law, as well as a failure to comply with legislative responsibilities of the Parliament.
President of the Parliament Mr Ranko Krivokapić has advised the negotiating team of former workers of KAP to address the Public Prosecution Office, and to point out the intention of non-compliance with the law of the state of Montenegro by those who are obliged to honour and enforce the law.
