Sixth Meeting of the Committee on Human Rights and Freedoms

At the meeting held today, the Committee on Human Rights and Freedoms considered the Plan of Activities of the Committee on Human Rights and Freedoms for 2013 made on the basis of: the European Commission Progress Report on Montenegro for 2012; the Program of the work of the Government of Montenegro for 2013, adopted on 31st January, 2013 as well as a number of implemented activities from the Plan of Activities of the Committee on Human Rights and Freedoms for 2012.

Special emphasis in the Plan of activities of the Committee was given to activities and competent institutions that should provide greater efficiency in the fields of:

- protection against discrimination,

- prevention of torture;

- children rights and

- the protection of personal data,

The activities of the Committee for  2013 will be directed towards:

- implementation of adopted laws, by strengthening control role of the (Articles 68,73,75 and 162 of the Rules of Procedure of the Parliament of Montenegro);

- rights of children, with special emphasis on the rights of children with disabilities;

- proportional representation of minorities and other minority ethnic communities in government bodies, local government and public services;

- exercise of the rights of refugees and internally displaced persons in Montenegro, in accordance with the recommendations of the European Commission against Racism and Intolerance of the Council of Europe (ECRI);

- protection from discrimination, by monitoring implementation of the prohibition of discrimination and participation in the improvement of its text by adopting amendments to the Law;

- prevention of torture and other inhuman, cruel or degrading treatment, in accordance with the recommendations of the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT);

- the protection of personal data;

- intensifying of international cooperation with entities that deal with the protection of human rights and freedoms, advisory bodies, the Council of Europe and the European Union, further strengthening the constructive role Montenegro has in regional cooperation, organizing visits to the relevant working bodies of other parliaments and organizing international conferences in order to achieve Parliaments role in the process of integration into European and Euro-Atlantic integration, in accordance with Art. 208, 209 and 210 of the Rules of Procedure of the Parliament of Montenegro.

All participants of the discussion pointed out the significance of adopting the Plan, assessing it as ambitious, high-quality, comprehensive and substantial, with well-chosen topics.

The selection of priority areas in which the Committee will pay special attention to during the 2013 was praised. The way of developing the plan was also praised, because the Proposal for the Plan of activities of the Committee for 2013 was sent to a number of subjects to give their opinions, proposals, suggestions, and a number of submitted proposals were accepted.

Representatives of international organizations have pointed out that the Proposal for the Plan of activities is very meaningful, comprehensive, ambitious, and meets the needs of Montenegro and all that is expected of it on the path to the European integration.

The Head of UNICEF Office in Montenegro, Mr. Benjamin Perks praised the Committee on Human Rights and Freedoms, stating that its activities contribute to protection and promotion of human rights and freedoms of all citizens. He stressed that he supported the activities set out in the Plan, and that he is particularly pleased that a significant number of activities are dedicated to childrens rights, with an emphasis on children with disabilities, their inclusion and strengthening support for the most vulnerable groups in society. He pointed out that in the last three years Montenegro has made great progress in the field of childs rights, that the model of inclusion of children with disabilities Montenegro develops can serve all other countries in the region, which is also assessed by the relevant entities in New York and Geneva. The cooperation of all social actors in the protection of childrens rights is very important. The legislative framework for the protection of childrens rights is good, and in the future the emphasis should be on implementation. Mr. Benjamin Perks commented on the Law on the treatment of juveniles in criminal proceedings, stating that it is important that this sensitive area is defined by the special Law that is compliant with international standards on the rights of the child. The adoption of the new Law on Social and Child Care, whose proposal was determined by the Government, asses as very important in the regulation of the rights of the child. Implementation of activities within the Council of Europe Campaign "One out of five" in which Montenegro also participates, he considers relevant and he announced that the UNICEF will create a research on the phenomenon of violence against children in Montenegro, which will serve as a basis for taking any further action by the relevant government authorities in order to prevent and combat violence against children.

Mr. Rastislav Vrbenski, UNDP Resident Representative in Montenegro, praised the work of the Committee on Human Rights and Freedoms, the proposed plan of activities, Committees cooperation with the UN agencies, as well as the practice of the Committee to discuss all topics related to human rights and freedom in the presence of all relevant parties, representatives of state institutions, and international organizations and civil society.

The representatives of the relevant institutions of the system, the relevant ministries and Ombudsman of Montenegro expressed a positive opinion about the planned activities of the Committee in the following period, suggested that it should be thought about the timeframe in which the implementation of certain activities is planned, expressed willingness to cooperate in order to achieve a common goal, the affirmation and promotion of human rights and freedoms in Montenegro.

The NGO representatives expressed a positive opinion about the planned activities of the Committee and hope that their activities will be realized, and that the Committee will continue to cooperate with the civil sector.

Members of the Committee on Human Rights and Freedoms are also agreed that the Plan of activities is comprehensive and ambitious, and matches the responsibilities and tasks of Montenegro are expected during this period.

The Chairman of the Committee on Human Rights and Freedoms Mr. Halil Duković, PhD found that the Plan of activities of the Committee is meaningful, comprehensive, ambitious but achievable, and expressed the expectation that all members of the Committee will contribute to its implementation, and with the cooperation of all social actors in Montenegro and the support of international organizations and NGOs, which will significantly contribute to further progress in the field of human rights and freedoms in Montenegro.

After a very substantive discussion, the Committee unanimously adopted the Plan of activities of the Committee on Human Rights and Freedoms for 2013.

Members of the Committee decided to visit the Committee of Human Rights and Minority Rights of the Croatia Parliament on 21st and 22nd March, 2013, the activity that was not realized by the Plan of activities of the Committee for 2012. Given that Croatia met all the standards for membership in the European Union, presenting the work of the Committee on Human Rights and National Minorities, and all other relevant institutions dealing with the protection of human rights and minority policy and good practice of the Croatian Parliament, the promotion of cooperation and exchange of experiences will be useful to all members of the Committee on Human Rights and Freedoms of Parliament of Montenegro in the future
