Towards the 110 years of Montenegrin constitutionality and 31 October - Parliamentarism Day

 

On this day in 2007, the Constitutional Parliament of Montenegro pronounced the Constitution of Montenegro, the second constitution of the independent state, and the seventh in sequence.

Towards the 110 years of Montenegrin constitutionality and 31 October - Parliamentarism Day, we remind that, on this day the Constitutional Parliament of Montenegro proclaimed the Constitution of independent Montenegro, renewed in May’s referendum of 2006.

The Constitution created a fundamental legal right for all other creations in our homeland. It has protected democratic institutions and the rule of law has been traced as a model of Montenegrin living.  Multi-ethnic harmony, created by wisdom of the centuries, has been protected by modern standards of human rights.

The path to new Constitution was initiated in 2003, when the Parliament formed the Council for constitutional issues from among professors of the University of Montenegro.  Back then, the cooperation with the Venice Commission, a consultative body of the Council of Europe for democracy through law, has started. In December 2006, the Venice Commission stated its positions on the expert version of the new constitution of Montenegro and assessment -  “ there is willingness in Montenegro for broad agreement on the core issues of the new Constitution”. It was confirmed in February 2007 by signatures of majority of political parties and the Government of Montenegro - seven fundamental principles of the Council of Europe for the new Constitution.  In June 2017, the Commission drafted opinion on the Draft Constitution with recommendations which have, through fifty five days of public discussion, been built into the text of the Constitution in a quality manner.

By the Constitution of 2007, the citizens have become holders of sovereignty in Montenegro, thus our state stepped out in the 21st century and ahead of others in the Balkans.

The highest legal act of our state completed institutionally its independence, renewed on 21 May 2006, opening the processes of overall democratisation of the society based on the citizen.   Back then Montenegro was registered as Euro-Atlantic, which has started to be achieved formally.

The Constitution of Montenegro restrained the authority and power, and thus created the room for all actors of power and system to lead processes based on democracy and election legitimacy through institutions.

The last amendments to the Constitution of Montenegro in the field of judiciary and prosecution have provided an additional independence and strength to pillars of the system which are key in preserving and strengthening the foundations of our state - the rule of law.

Parliament of Montenegro proved to be strong institution of democracy in important political moments for our state. Not only by adopting the Constitution, but by defending it and reaching important decisions, controlling the power, opening its door to civil society and citizens, which is being continuously recognised by the European Commission in its reports, by the Venice Commission and from numerous addresses of international community.

May eternal be Montenegro, may eternal be its parliamentary democracy.
