At its 70th meeting held today, the Administrative Committee of the Parliament of Montenegro of the 25th Convocation considered the Request by the Basic Court in Rožaje File No 45/16 of 6 April 2016, for approving the initiation of a criminal proceeding against a member of the Parliament of Montenegro Mr Radovan Asanović.
Following the discussion, the Committee has decided not to vote on the submitted Request by the Basic Court in Rožaje, bearing in mind that the elections for members of the Parliament of Montenegro are scheduled for 16 October 2016, and it is unknown whether the named party would be a member of the new Convocation of the Parliament of Montenegro.
In accordance with Article 8 paragraph 1 of the Decision on special advisors at the Parliament of Montenegro, the Committee has decided to remove Ms Jelena Mitrović from office of the advisor to the former President of the Parliament of Montenegro, due to termination of mandate of the former President of the Parliament of Montenegro.
In continuation of the meeting, in accordance with Article 31 paragraph 6 of the Law on Public Sector Salaries, determining that the decision on salaries of persons who were elected, appointed, or nominated in accordance with regulations shall be adopted by the body or the working body which elected, appointed, or nominated them, and in relation to the Request by the Council of the Insurance Supervision Agency for rendering a decision on earnings of the President of the Council of the Agency and decision on allowances for members of the Council of the Agency, the Administrative Committee has decided to render the adequate decisions.
Acting upon the Request by the Council of the Agency for Personal Data Protection and Free Access to Information for rendering decisions on earnings of the President and members of the Council of the Agency, and bearing in mind the collision of provisions of the Personal Data Protection Law and the by-laws of the Agency with the Law on Public Sector Salaries, the Committee has decided not to render decisions on earnings of the President and members of the Council of the Agency until the collision of legal norms is resolved as the previous issue.
The Committee has also been informed on the submitted Request by the Council of the Agency for Electronic Media for rendering decisions on allowances of the President and members of the Council of the Agency, and it noted that there was a collision of legal norms between the Law on Electronic Media and the Law on Public Sector Salaries, and in accordance with that there were no legal prerequisites for adopting legally valid solutions.
In relation to the Request by the Ministry of Economy of the Government of Montenegro, and with regard to the decisions of the Agency for Prevention of Corruption determining that Mr Milutin Korać and Mr Goran Dašić, members of the Commission for Concessions of Montenegro, had violated Article 23 paragraph 3 item 1 of the Law on Prevention of Corruption as public officials, the Committee has noted that the Parliament of Montenegro was the authorised proposer and that it was not competent to act in this concrete case.
