MP Mr Neven Gošovićexplained Amendments (3) to the Proposal for the Law on Strike
Representative of the proposer Mr Slobodan Filipović, Director of the Labour Directorate in the Ministry of Labour and Social Welfare, proposed legal and technical reformulation of Amendment 1, and MP Gošović agreed on that. The Committee unanimously supported legal and technical reformulation of Amendments 1, and proposed to the Parliament to adopt thereof.

Representative of the proposer did not agree on Amendment 3 by MP Neven Gošović. Due to the result of voting (two “for”, three “against” and one “abstained”), the Committee on Human Rights and Freedoms did not form a position regarding Amendment 3 and it does not have a proposal for the Parliament. Within the item “Current issues”, Committee members agreed to visit Special Psychiatric Hospital “Dobrota” – Kotor, in line with Conclusion of the Committee from 37th meeting of 4 November 2014. The visit will be organised on 17 February 2015. Additionally, the Committee agreed to visit PI Children’s Home “Mladost” in Bijela, on the same day. Following these visits, on 17 February 2015, the Committee on Human Rights and Freedoms, in cooperation with the UNICEF Office to Montenegro, will hold a public debate titled: “The Rights of the Child – Foster Care” in the Great Hall of the Local Assembly Herceg Novi.
Additionally, within the item “Current issues”, Committee Chairperson informed Committee members that on 9 February 2015, in the late afternoon, a Letter-Application was submitted to the Committee on Human Rights and Freedoms, by NGO Network for Affirmation of Non-Governmental Sector (MANS), by which the urgent convening of a meeting of the Committee on Human Rights and Freedoms was initiated, for the purpose of discussing the Proposal for the Law on Amendments to the Law on National Security Agency.
Committee Chairperson informed Committee members that on 10 February 2015 he sent an answer to MANS, informing them that the said Proposal for the Law had been considered by the Security and Defence Committee in the capacity of a competent (lead) committee, in line with Article 41 of the Rules of Procedure of the Parliament of Montenegro, at its 28th meeting of 3 October 2014, and decided – by a majority of votes – to propose to the Parliament to adopt the Proposal for the Law on Amendments to the Law on National Security Agency. Additionally, the Legislative Committee, at the meeting of 24 November 2014 considered that Proposal for the Law, and assessed that with appropriate amendment corrections, it was in accordance with the Constitution and the legal system.
Committee Chairperson pointed out that Article 137 of the Rules of Procedure of the Parliament of Montenegro envisages that committees which, apart from the lead committee, discuss a Proposal for the Law, shall submit their opinion to a lead committee, taking care about the deadline, so that the lead committee can consider their opinions.
As the Defence and Security Committee and Legislative Committee have already discussed the Proposal for the Law on Amendments to the Law on the National Security Agency and reached a decision on that, it is clear that consideration of this Proposal for the Law by the Committee on Human Rights and Freedoms would have no purpose.
Members of the Committee discussed the Request for control hearing of Minister of Interior Mr Rasko Konjević and Director of the Police Administration Mr Slavko Stojanović on the topic: "Missing Persons in Montenegro" submitted by MPs Mr Zoran Miljanić, Ms Ljiljana Đurašković and Mr Radovan Asanović, Committee Chairperson Mr Halil Duković stated that these issues were within the competences of the Security and Defence Committee, as the Rules of Procedure of the Parliament of Montenegro stipulates that the Security and Defence Committee, among other, performs parliamentary control of the work of police, National Security Agency and other security organs and services, and considers exercising of the constitutionally established rights and freedoms of citizens in the application of the powers of the police and the National Security Agency and other security bodies and services.
Bearing in mind that members the Committee consider that the Committee on Human Rights and Freedoms should consider this topic from a humanitarian point of view, it was decided that the Chairperson the Committee on Human Rights and Freedoms should send letter to the Chairperson of the Security and Defence Committee with a proposal for holding a joint thematic meeting of the two committees, on the topic: "Missing Persons in Montenegro".
