At the second meeting of the Committee on Human Rights and Freedoms held today, the Proposal for the Law on Amendments to the Law on Civil Servants and State Employees was considered.
Mr. Veselin Vukčević, Deputy Minister of the Interior attended the meeting as the authorised representative of the proponents.
He pointed out that the reasons for adopting the law in a shortened procedure were such that not adopting it could cause harmful effects to irrational spending of budget and other funds for severance payments.
Under the proposed Amendments to the Law on Civil Servants and State Employees, prohibition of entering into employment, apart from state bodies, expands to include the following legal persons: Pension and Disability Insurance Fund of Montenegro, Health Insurance Fund of Montenegro, Employment Office of Montenegro, Work Fund and Agency for Amicable Settlement of Labour Disputes.
Under the proposed Amendment to the Law, prohibition in terms of re-entering into employment in a state body for the persons who terminated employment for objective reasons, under the force of the law, is set out for a period of one year since the day of receiving severance payment, except for persons who return the total amount of severance payment received.
Also, under the proposed Amendments to the Law, it is prescribed that limiting employment in a state body does not refer to persons who return the total amount of severance payment received and prohibition of employment in state bodies or legal persons (Pension and Disability Insurance Fund of Montenegro, Health Insurance Fund of Montenegro, Employment Office of Montenegro, Work Fund and Agency for Amicable Settlement of Labour Disputes) is established for persons who terminated their employment based on a written agreement, and who exercised the right to receive severance payment in accordance with the Government’s regulation, in the period of five years since the day of severance payment received. However, this limitation shall not refer to persons who return the total amount of severance payment received.
After explanations made by the representatives of proponents and the discussion, the Committee supported Proposal for the Law on Amendments to the Law on Civil Servants and State Employees by a majority of votes (seven “for”, one “abstained”) and decided to propose to the Parliament to adopt it in a shortened procedure.
