At today's 56th meeting, the Committee on Political System, Judiciary and Administration, by majority vote supported amendments (3) on the Proposal for a Decision on Establishment of the Interim Committee on supervising the work of state authorities, state administration authorities and local government bodies in view of the consistent application of the Law on Building Trust in the Election Process, submitted by MPs: Azra Jasavić and Srđan Perić. The amendments were accepted by the proposer, and thus have become the integral part of the Proposal for a Decision.
According to Article 73 paragraph 1 of the Rules of Procedure of the Parliament of Montenegro, the Committee held consultative discussion with the members of the Working Group, who participated in the drafting of laws in the field of judiciary: Draft Law on the Judicial Council, Draft Law on the rights and duties of judges and Draft Law on Public Prosecution Office.
On behalf of the Working Group that participated in drafting the Draft Law on the Judicial Council and the Draft Law on the rights and duties of judges, the meeting of the Committee was attended by Branka Lakočević, Tatjana Radović, Nataša Radonjić, Radule Kojović, Julka Badnjar and Stanka Vučinić.
Also, the meeting was attended by the members of the Working Group for drafting the Draft Law on Public Prosecution Office: Stojanka Radović, Miljana Radović and Merima Baković, while Branka Lakočević and Nataša Radonjić are at the same time members of the previous Working Group.
Also, the meeting was attended by Mihael Hausner, legal adviser in the Ministry of Justice.
Within the comprehensive and constructive discussion, opinions were exchanged with members of the working group and certain proposals and suggestions sent to the members of the Committee in relation to solutions contained in the mentioned draft laws.
When it comes to the Draft Law on Courts, it was discussed about solutions concerning the jurisdiction of courts for conducting criminal proceedings, in a way where a criminal system would be introduced in the regular judiciary, and thus two alternatives have been given, in order to come up with the best solution. Also, the word was about the reorganization of commercial courts, as well as the centralization of jurisdiction for criminal offences of organized crime, corruption, war crimes and terrorism.
Regarding the Draft Law on the rights and duties of judges and the Draft Law on the Public Prosecution Office, the word was about the proposed solutions related to the election of judges and court presidents, the criteria for promotion of judges, the system of disciplinary responsibility of judges and prosecutors, as well as evaluating the public prosecutors and heads of public prosecution office. Regarding the Draft Law on the Public Prosecution Office, the special attention of the Committee members was paid to the proposed establishment of the Special Public Prosecution Office, as a special public prosecution office for the fight against organized crime and corruption.
